Accepting these terms
These Terms of Service cover our digital products and services, including websites and mobile apps, collectively called the "Services". This is a legal agreement between you (the "user") and Rising Pilot (the "Company", "we", or "us"). These terms govern how you access and use the Services. BY USING THE SERVICES, YOU AND ON BEHALF OF YOUR CHILDREN AGREE TO THESE TERMS. IF YOU DON'T AGREE, DON'T USE THEM.
When we change these terms or the Services
We can change these terms whenever we want. Updates take effect when posted. You're responsible for checking back regularly. Keep using the Services means you accept the changes. We can also change the Services or remove content at any time. We're not liable if any part becomes unavailable.
Using the Services
Your information matters to us. We use security measures to protect it from loss and unauthorized access. You're responsible for your own account security. Make sure anyone accessing through your connection knows these terms and follows them. All information you provide must be correct and current. If it changes, contact us right away. Internet transmission isn't completely secure. We protect what we can, but we can't guarantee it. Any transmission is at your own risk. We're not responsible if someone gets around our privacy settings or security measures. Don't try to break into the Services or bypass security. This includes accessing data not meant for you, breaking authentication, disrupting service for others, copying packet headers, interfering with monitoring, using automated tools to scrape content, uploading viruses or malicious code, launching denial-of-service attacks, or messing with how the Services work.
Creating an account and subscriptions
Some parts of the Services, like membership on risingpilot.com, need an account with a username and password. You must be at least 18. You can also log in through Apple ID or Google. Don't share your login details. You're responsible for what happens on your account. We can terminate it whenever we want. To access membership features, you need to buy a subscription. You can purchase on risingpilot.com, the Apple App Store, or Google Play Store. One subscription works across multiple devices. Membership itself is free, but certain content and features require a paid subscription. You'll pay a subscription fee based on your chosen period: one month, six months, or one year. We can change the fee with written notice, effective at the end of your current period. Your subscription renews automatically unless you cancel before it expires. It renews for the same length as before (one-year renews as one-year, monthly as monthly). Pay with whatever method the payment processor accepts, like a credit card. Buying a subscription means you authorize automatic charges at the start of each period. No payment means no access. Cancel anytime, effective at the end of your current period. If you bought on risingpilot.com, cancel in "My Account". If through Apple or Google, use their subscription management. After cancellation, you keep access until your period ends, then no more charges.
Intellectual property
Everything on the Services—content, features, functionality, information, software, text, graphics, photos, video, audio, design, selections, arrangements—is owned by the Company and protected by copyright, trademark, and other intellectual property laws. All trademarks, logos, product names, designs, and slogans belong to us or others. Don't use them without written permission. Unauthorized use is infringement and could lead to legal action. You can only use the Services for personal, non-commercial purposes. Don't remove copyright or trademark notices. Don't modify, copy, distribute, create derivatives, display, perform, republish, download, store, or transmit anything unless we've given written permission or it's allowed by law. We do permit these specific uses where applicable: Your browser may cache copies of content you're viewing. You can download and print a reasonable amount of content from our Free Resources section for personal, non-commercial use only, provided you keep proprietary notices intact. We decide what's reasonable. If social media platforms link to certain content, you can use whatever actions those platforms specifically allow. If you breach these terms by printing, copying, or downloading our Services, your access stops immediately and you must return or destroy copies at our option. You don't own the Services or any content. All rights not granted here belong to us. Unauthorized use breaches these terms and may violate copyright, trademark, or other intellectual property laws, leading to legal action.
What you submit and how you can use the Services
We don't ask for confidential or proprietary information. If you submit materials, content, information, or ideas ("User Submissions"), you represent that they're original to you, no one else has rights to them, and you've waived moral rights. You give the Company a non-exclusive, fully paid, royalty-free, perpetual, irrevocable, transferable, sublicensable, worldwide license to reproduce, modify, adapt, publish, perform, display, distribute, create derivatives, sell, and use your submissions however we choose, commercially or otherwise, without compensation or credit to you. We're not responsible for maintaining submissions and may delete them anytime. Your use of the Services and submissions must not: Violate any applicable law. Break the terms of any linked third-party site, including social media. Include exploitative, obscene, harmful, threatening, abusive, harassing, hateful, sexually explicit, pornographic, violent, or inflammatory material, or content that discriminates based on race, sex, religion, nationality, disability, sexual orientation, age, or other protected grounds. We decide what's objectionable. Involve stalking, exploiting, or harming anyone (especially minors) by exposing them to inappropriate content or requesting personal information illegally. Contain false, inaccurate, or misleading information. Suggest they come from us or have our endorsement when they don't.
Enforcement, suspension, and termination
We can take action without notice regarding any submission we deem inappropriate, including violations of these terms. We can also take legal action, refer to law enforcement, or share information with harmed parties. We cooperate fully with law enforcement and court orders requesting identity or other user information. We can terminate or suspend your access to all or part of the Services for any reason, including violations. YOU WAIVE AND HOLD HARMLESS THE COMPANY, ITS SUBSIDIARIES, AFFILIATES, AND THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS, AND SUCCESSORS FROM ANY CLAIMS RESULTING FROM OUR ACTIONS OR INVESTIGATIONS, OR LAW ENFORCEMENT ACTIONS.
Don't rely on this alone
The Services Content is for general information only. It's not advice you should rely on. Get specific or professional advice before acting on anything here. We try to keep content accurate, but we don't guarantee it's correct, complete, or current. Using the Services is at your own risk. Neither we nor our affiliates have any responsibility for how you use them.
Privacy
By using the Services, you consent to how we collect, use, host, transmit, and share your information under our Privacy Policy. If you don't agree with it, don't use the Services.
Links to other websites
We may link to third-party sites, but we make no claims about them. Access them at your own risk. We don't control their content and aren't responsible for them or any damage from using them. Their terms apply to you. You can link to us if you do it fairly and legally without damaging our reputation. Don't create links that suggest we endorse something we don't. Don't frame our Services on another site. We can remove linking permission anytime without notice. You agree to stop any unauthorized framing or linking immediately if we ask.
Buying things online
Orders and purchases on risingpilot.com are processed by Shopify and Stripe, which have their own terms and privacy policies. We're not responsible for them. Review their policies before buying.
Copyright complaints
We take copyright infringement seriously and have procedures for complaints. We've designated an agent to receive notices. We'll respond to legitimate complaints under applicable law. If you believe your copyright was infringed, submit a written claim to the email or address at the bottom of these terms. Your notice must include: (1) your signature or authorized representative's signature; (2) description of the copyrighted work you think was infringed; (3) where on our site the infringing material is; (4) your email, mailing address, and phone number; (5) a statement that you believe the use isn't authorized by the copyright owner or the law; and (6) a statement under penalty of perjury that your information is accurate and you own the copyright or are authorized to act for the owner. If you think a complaint against you was wrong, submit a counter-notice to the same email or address. Include: (1) your signature; (2) identification of the removed or disabled material; (3) a statement under penalty of perjury that removal was a mistake or misidentification; and (4) your full name, email, mailing address, and agreement that you'll accept service from the person who filed the complaint. You also consent to jurisdiction in Federal District court in your judicial district (or Ontario if outside the US).
No guarantees
YOU UNDERSTAND THAT USING THE SERVICES IS AT YOUR OWN RISK. THE SERVICES AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THIS DOESN'T AFFECT GUARANTEES THAT CAN'T BE EXCLUDED BY LAW. WE MAKE NO WARRANTY ABOUT THE COMPLETENESS, SECURITY, RELIABILITY, ACCURACY, CURRENCY, OR AVAILABILITY OF THE SERVICES OR CONTENT. WE DON'T REPRESENT THAT THE SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE FIXED, OR THAT SERVERS ARE FREE OF VIRUSES OR HARMFUL CODE. WE CAN'T GUARANTEE FILES OR DATA AVAILABLE FOR DOWNLOAD ARE VIRUS-FREE OR SAFE. YOU'RE ENTIRELY RESPONSIBLE FOR YOUR USE AND YOUR COMPUTER AND DATA SECURITY. TO THE FULLEST EXTENT ALLOWED, WE'RE NOT LIABLE FOR DAMAGE FROM ATTACKS, FLOODING, VIRUSES, WORMS, MALWARE, OR OTHER HARMFUL CODE THAT INFECTS YOUR EQUIPMENT, PROGRAMS, DATA, OR MATERIALS DUE TO USING THE SERVICES OR DOWNLOADING ANYTHING FROM THEM OR LINKED SITES.
Limits on what we owe you
WHERE THE LAW ALLOWS, WE'RE NOT LIABLE FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, EXEMPLARY, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, EMOTIONAL DISTRESS, LOST REVENUE, LOST PROFITS, LOST BUSINESS, LOST SAVINGS, LOST USE, LOST GOODWILL, OR LOST DATA, WHETHER FROM BROKEN CONTRACTS, NEGLIGENCE, OR OTHER CAUSES ARISING FROM USING OR RELYING ON THE SERVICES, EVEN IF WE KNEW SUCH DAMAGES WERE POSSIBLE. WHERE ALLOWED, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USING THE SERVICES WON'T EXCEED WHAT YOU PAID US IN THE MONTH BEFORE THE PROBLEM HAPPENED.
You defend us
To the extent the law allows, you agree to defend, indemnify, and hold harmless the Company and its affiliates from any claims, liabilities, damages, losses, costs, or legal fees arising from your breach of these terms or use of the Services, including your submissions, third-party sites, misuse of content, or unauthorized use of services and products.
Which laws apply
These terms are governed by Ontario law and Canadian federal law, without regard to conflict of law rules, regardless of where you live. Any lawsuit goes to Ontario courts. Both parties submit to their exclusive jurisdiction. You waive objections to venue. YOU WAIVE THE RIGHT TO SUE US AS PART OF A CLASS ACTION.
Waiver
If we don't enforce a right, that's not a waiver. Partial enforcement doesn't prevent us from enforcing it fully later.
Severability
If any part of these terms is invalid or unenforceable, the rest stays in effect.
The whole agreement
These terms and our Privacy Policy are the complete agreement between you and the Company about the Services and replace all prior understandings, written or oral.
